Brand Selection

If you are in the process of developing new brands, logos, slogans or a new corporate identity, you will need advice on whether the brands you are considering meet the legal criteria for registrability.

If your brands are not distinctive (e.g. if they are descriptive) then they will not be registrable as trademarks.  If you cannot obtain a trademark registration for your brand, then you can never have the exclusive statutory right to use it or prevent others from using it.  This can have an enormous impact on the ultimate value and viability of the brand which is vital to know before you start investing heavily in promoting it.

We can work closely with you, or directly with your marketing agencies, on the creation and adoption of new trademarks so that these legal pitfalls can be avoided.
