5.7 – Oppositions Against Third Party TMs

On receipt of an expression of interest by an existing or new client in opposing registration of a UK trademark, you will need to:

  • Create Address Book records for the parties. If our client is not yet entered, we will need to do the usual checks (see 3.1.2 Collecting Information for a New Client Record) before creating a record. The applicant for the disputed trademark will be entered as an Otherside client, and their representative as Otherside Solicitor;
  • Then create an Opposition file for the client, choosing sub Category as TM Offensive, and enter the details of the opposed mark, as well as the Otherside parties;
  • Create the “Trademark possible UK opposition” e-mail to the client, making sure that the wording is adapted to suit the circumstances – the handling attorney will need to review the email before sending to see that it agrees with the initial enquiry.
  • Set a task for a week to follow up if no instructions are received.
