5.1.1 – UKTA – Preliminaries

Unless the specification(s) of goods/services is/are the same as those in an earlier registration for the same applicant, the fee earner will need to draft these and they will need to be entered into the case file on the Details tab.

Make sure that the following details are available in the Equinox case file before moving to the application stage:

  • The type of mark, i.e. word or device. If it is a device mark, make sure you have the device image file (as a jpg file);
  • the full name and address of the or each applicant – if the applicant (owner) is not an individual, then you will need to know, if it is a UK company, the type of company – e.g. Limited company or limited liability partnership – and the company registration number.
  • For foreign applicants, you will need to know the country of incorporation for a company, or of residence for an individual.
  • Note that partnerships are treated as merely joint individual applicants, unless they are an LLP or foreign equivalent. The consideration is that a company must be able to hold property in its own name. An ordinary partnership has no existence separate from the partners.

The steps in setting up the file are:

  • Create a new client record in Address Book in Equinox (assuming the company or individual is not yet entered there). Make sure that the company (or individual) is also entered as an applicant. Don’t forget to check the Finance Settings tab to ensure that Tax date +(in days) box is updated to 30 (or whatever has been agreed – the default is 30).   • On the Dashboard, start entering the client name in the “New Case For” box and then select the correct name as offered.
  • The Applicant will normally be “Key Applicant”, but in some cases it will be different.
  • Category will be Trade Mark and sub-category will usually be “First Filing”, unless you have been advised otherwise (e.g. claiming priority).
  • The short title will be the trademark or, if it is a device mark, a description of the mark.
  • Enter the class numbers, if you know them, and the goods/services if you have them – see above.
