5.3.1 – Filing a Madrid Application

  • Start off in Trade mark forms and fees on the IPO website, using MM2.
  • File the MM2, don’t fill in the fee calculation sheet, but you will need to complete the FS4 sheet. If the US is designated then you will need to submit a form MM18 as well at the same time. This needs to be signed by the client.
  • The IPO then review the application and if all is in order, they pass it to WIPO. We will get confirmation of this and we usually report this to the client.
  • Then after a short while we will get an irregularity notice from WIPO due to non payment of the application fees. This provides a website and reference number to pay and means we can pay by credit card. Also, due to the delay between the MM2 and the notice of irregularity it gives time for the client to pay their invoice, so we are not out of pocket.
